Términos de servicio

Estos términos regulan el uso de ShowMetrics, una plataforma para productoras de eventos que cruza ventas, inversión publicitaria y operación de shows.

1. Aceptación

Al crear una cuenta, acceder o usar ShowMetrics, aceptás estos Términos de Servicio. Si usás ShowMetrics en nombre de una productora, empresa u organización, declarás que tenés autoridad para aceptar estos términos por esa entidad.

2. Definiciones

  • ShowMetrics, nosotros: el Servicio operado por DenkerLab, con sede en los Países Bajos.
  • Servicio: la plataforma web, APIs, integraciones, dashboards y funcionalidades relacionadas.
  • Espacio de trabajo: la organización o productora para la que se configura una cuenta.
  • Usuario: persona con credenciales para acceder a un espacio de trabajo.
  • Datos de terceros: datos obtenidos desde Meta, ticketing u otros proveedores conectados por vos.

3. Cuenta y acceso

Sos responsable de mantener la confidencialidad de tus credenciales y de toda actividad que ocurra con tu cuenta. Debés usar información verdadera y mantener actualizados tus datos de contacto. Si sospechás acceso no autorizado, avisanos a security@showmetrics.app. Debés tener al menos 18 años para usar el Servicio.

4. Uso permitido

No podés usar el Servicio para:

  • Violar leyes aplicables, derechos de terceros o términos de plataformas conectadas.
  • Acceder o intentar acceder a datos de otros espacios de trabajo.
  • Interferir con la infraestructura, seguridad o disponibilidad del Servicio.
  • Conectar cuentas de ticketing, Meta o publicidad que no estés autorizado a administrar.
  • Revender, copiar, descompilar o explotar el Servicio fuera de lo permitido por estos términos.

5. Integraciones de terceros

ShowMetrics se integra con Meta Platforms y plataformas de ticketing. El uso de esas integraciones también se rige por los términos y políticas de cada proveedor. No somos responsables por cambios, demoras, errores, disponibilidad o decisiones de esos proveedores. Al desconectar una integración, tratamos los tokens y datos históricos según la Política de privacidad y las instrucciones de eliminación.

6. Tus datos

Conservas tus derechos sobre los datos que cargás o conectás. Nos otorgas una licencia limitada para alojar, procesar, transformar y mostrar esos datos solo para prestar, mantener, proteger y mejorar el Servicio para vos y tu espacio de trabajo.

7. Propiedad intelectual

El Servicio, su software, diseño, marca, documentación y contenidos propios pertenecen a ShowMetrics o sus licenciantes. Estos términos no te otorgan derechos sobre la marca ShowMetrics, salvo para identificar el Servicio.

8. Cambios del Servicio

Podemos modificar, agregar o retirar funcionalidades. Procuraremos avisar con anticipación cambios materiales que afecten funcionalidades pagas o centrales. Las métricas pueden diferir de las plataformas de origen por ventanas de atribución, demoras, redondeos o revisiones.

9. Garantías y responsabilidad

El Servicio se presta "tal como está" y "según disponibilidad". En la medida permitida por ley, no garantizamos disponibilidad ininterrumpida, ausencia de errores ni exactitud perfecta de los datos importados. En la medida permitida por ley, no seremos responsables por daños indirectos, lucro cesante, pérdida de ingresos, pérdida de datos o daños punitivos. Nuestra responsabilidad total no excederá el mayor entre lo pagado a ShowMetrics durante los 12 meses previos al hecho que origina el reclamo o USD 100.

10. Suspensión y terminación

Podés dejar de usar el Servicio en cualquier momento. Podemos suspender o terminar el acceso si hay incumplimiento material, riesgo de seguridad, falta de pago o necesidad legal. Tras la terminación, se aplican la Política de privacidad y las instrucciones de eliminación.

11. Ley aplicable y jurisdicción

Estos términos se rigen por las leyes de los Países Bajos. Salvo que una norma imperativa (incluida la normativa de protección al consumidor) disponga otra cosa, cualquier disputa será sometida a los tribunales competentes de los Países Bajos.

12. Cambios y contacto

Podemos actualizar estos términos. La fecha superior indicará la versión vigente. El uso continuado del Servicio después de un cambio implica aceptación de los nuevos términos. Contacto: legal@showmetrics.app.

1. Acceptance

By creating an account, accessing, or using ShowMetrics, you accept these Terms of Service. If you use ShowMetrics on behalf of a production company, business, or organization, you represent that you have authority to accept these terms for that entity.

2. Definitions

  • ShowMetrics, we, us: the Service operated by DenkerLab, established in the Netherlands.
  • Service: the web platform, APIs, integrations, dashboards, and related features.
  • Workspace: the organization or production company for which an account is configured.
  • User: an individual with credentials to access a workspace.
  • Third-Party Data: data obtained from Meta, ticketing, or other providers you connect.

3. Account and access

You are responsible for keeping your credentials confidential and for all activity under your account. You must provide accurate information and keep your contact details current. Notify us at security@showmetrics.app if you suspect unauthorized access. You must be at least 18 years old to use the Service.

4. Acceptable use

You may not use the Service to:

  • Violate applicable law, third-party rights, or terms of connected platforms.
  • Access or attempt to access other workspaces' data.
  • Interfere with the infrastructure, security, or availability of the Service.
  • Connect ticketing, Meta, or advertising accounts you are not authorized to administer.
  • Resell, copy, decompile, or exploit the Service outside what these terms allow.

5. Third-party integrations

ShowMetrics integrates with Meta Platforms and ticketing platforms. Your use of those integrations is also governed by each provider's terms and policies. We are not responsible for changes, delays, errors, availability, or decisions of those providers. When you disconnect an integration, we handle tokens and historical data according to the Privacy Policy and Data Deletion Instructions.

6. Your data

You retain your rights to data you submit or connect. You grant us a limited license to host, process, transform, and display that data only to provide, maintain, protect, and improve the Service for you and your workspace.

7. Intellectual property

The Service, software, design, brand, documentation, and owned content belong to ShowMetrics or its licensors. These terms do not grant you rights to the ShowMetrics brand except to identify the Service.

8. Changes to the Service

We may modify, add, or remove features. We will seek to give advance notice of material changes that affect paid or core functionality. Metrics may differ from source platforms because of attribution windows, delays, rounding, or revisions.

9. Warranty disclaimer and liability

The Service is provided "as is" and "as available". To the extent permitted by law, we do not warrant uninterrupted availability, error-free operation, or perfect accuracy of imported data. To the extent permitted by law, we will not be liable for indirect damages, lost profits, lost revenue, loss of data, or punitive damages. Our total liability will not exceed the greater of the amount paid to ShowMetrics during the 12 months before the event giving rise to the claim or USD 100.

10. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for material breach, security risk, non-payment, or legal necessity. After termination, the Privacy Policy and Data Deletion Instructions apply.

11. Governing law and venue

These terms are governed by the laws of the Netherlands. Unless mandatory law (including consumer protection law) provides otherwise, any dispute will be submitted to the competent courts of the Netherlands.

12. Changes and contact

We may update these terms. The date above reflects the current version. Continued use of the Service after a change constitutes acceptance of the new terms. Contact: legal@showmetrics.app.
